Extended collective exercise of rights

§ 571 of the Copyright Act allows the collective management organisation to agree with the users in certain cases that the licence agreement also extends to the authors, i.e. the rights holders, who have not authorised the collective management organisation to represent them.

A rights holder who has not authorised the collective management organisation that concludes the collective licence agreement, may exclude the use of their work on the basis of the collective licence agreement at any time by informing the collective management organisation about this, who in its turn will immediately inform the other party thereof.

The EAÜ is a collective management representation that represents the vast majority of the authors of musical works, works of art and audiovisual works in Estonia. Thus, the EAÜ has the right to enter into such extended collective licence agreements in certain cases.

The list of the collective licence agreements entered into by EAÜ is published here.

If your work is used under a licence agreement given in the list and you are not a member of the EAÜ, the Estonian Audiovisual Authors Association or any other national collective management organisation representing authors of musical works, works of art or audiovisual works, and you do not want your work to be used under such an extended licence agreement, please let the EAÜ know. Please e-mail the respective message to the EAÜ at eau@eau.org
